In such a procedure, there would be little use for advocates to present the evidence.  The historical evidence of this development, however, is fragmentary.  The adversary system was also employed in equity, where its use does not appear to have been so necessary.  These include: supervising the seating of a jury from among the citizens summoned for jury duty; at the beginning of trial, describing to the jury the Page 22 general nature of the case and their responsibilities in deciding issues of fact; acting as umpire in the course of the trial, to restrain the advocates from pursuing irrelevancies or becoming overzealous; after all the evidence has been received, giving instructions to the jury about the legal principles to be applied in reaching a verdict; and, after the trial is over, considering whether there were mishaps at trial so prejudicial that a retrial should be held.

For example, distinctions remained, even under the codes, between "actions at law" and "suits in equity," apart from the problem of jury trial.  These and other difficulties remained embedded in the code­ pleading system through 1938.  Accordingly, the new federal first­instance courts were endowed with competence in cases involving the government and in those in which the parties were citizens of different states.  Such was the provision of a statute adopted during the first sitting of the Congress of the United States in 1789, known as the Conformity Act.

Administrative regulations augment the statutes and generally have the same force as statutory law.  For further example, statutes impose requirements for public filing of relevant information in various kinds of financial transactions and also impose civil liability on a seller who fails to provide truthful information to the buyers in such transactions.  Thus, government agencies and officials have only such authority as is conferred by law, and the courts have authority to determine what the law has conferred.
